2025 Ubbi Dubbi DJ Contest Official Rules

1. KEY DATES

The 2025 Ubbi Dubbi Music Festival (the "Festival") DJ Contest (the "Contest") entry period begins at 12:00:00 a.m. Central Standard Time (CST) on Thursday, January 30, 2025, and ends at 11:59:00 p.m. CST on Friday, February 7, 2025 (the "Entry Period"). Entries received before or outside of the Entry Period will not be accepted or be eligible to win, except as otherwise set forth in these Official Rules (the "Terms"). The fan-voting period will begin at 12:00:00 a.m. on Monday, February 10, 2025, and end at 11:59:00 p.m. CST on Sunday, February 16, 2025.

2. ELIGIBILITY

The Contest is open only to participants eighteen (18) years of age or older at the time of entry who are legal residents of the United States and District of Columbia, excluding residents of Alaska and Hawaii. Void in Puerto Rico, U.S. territories and possessions and wherever prohibited or restricted by law.

To be eligible, participants must have a valid Discord account and must have joined the Disco Presents Discord server (the "Discord Server"). You may sign up for a Discord account for free at discord.com/register and join the Discord Server at https://discord.gg/CzEUn8Rk6K.

Employees, agents, officers, and directors of Disco Presents Inc. (the "Sponsor"), its respective parent, subsidiary and affiliate companies, advertising, promotion or production agencies, prize providers, and their immediate family members or individuals residing in their same household, are not eligible to participate or enter the Contest. Participants agree to be bound by all decisions of Sponsor, which are binding and final.

3. HOW IT WORKS

During the Entry Period, participants must join the Discord Server and submit their entry to the DJ Contest Channel (the "Submission"). The Submission must consist of an original mix of approximately one (1) hour in length prepared by the participant and comply with the any instructions and/or criteria as outlined by the Sponsor in the Discord Servicer and/or DJ Contest Channel. Each participant is limited to one (1) Submission, Sponsor shall have the right to remove any duplicate Submissions, in its sole discretion.

All Submissions must be in an acceptable audio format (.mp3 or .wave files are preferred), no video submissions, links, or other formats or types of files will be accepted. All Submissions must follow the Submission guidelines set forth below. Submissions may or may not be acknowledged, in Sponsor's sole discretion. Sponsor is not responsible for Submission complications, technical difficulties or unregistered or unrecorded Submissions. Complying with Sponsor's instructions and these Terms will generate one (1) entry into the Contest. Any participant who enters after the close of the Entry Period, or who submits a Submission that is not in compliance with these Terms, will not be given an entry into the Contest. Each participant may obtain only one (1) entry into the Contest. Any attempt by participant to obtain more than the stated number of entries by using multiple or different e-mail accounts, identities, registrations and logins, or any other methods will void that participant's entry and that participant may be disqualified from the entire Contest in the sole discretion of Sponsor.

4. SUBMISSION GUIDELINES

Only Submissions that meet the Submission guidelines set forth below will be considered a Submission. In order to be eligible for this Contest, your Submission may not (as determined in the sole discretion of Sponsor):

  • Contain a sample or music or sound clip owned by another individual unless the required permissions have been obtained;
  • Contain any false or misleading statements on the entry form or plagiarize, replicate, or copy any other submitted Submission;
  • Be sexually explicit, obscene, profane, or offensive;
  • Be unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group;
  • Promote alcohol, illegal drugs, tobacco, firearms, or weapons of any kind (or the use of any of the foregoing);
  • Promote any activities that may appear unsafe or dangerous;
  • Endorse any form of hate or hate group;
  • Contain materials embodying the names, voices, or other indicia identifying any person, including, without limitation, celebrities and or other public or private figures, living or dead;
  • Communicate messages inconsistent with the positive images and/or good will to which Sponsor wishes to associate;
  • Contain a virus, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or other harmful or malicious component;
  • Violate the Discord Terms of Service (https://discord.com/terms) or any other applicable terms; and/or
  • Violate any law.

All Submissions that do not comply with these Terms or that otherwise contain prohibited, or inappropriate content deemed unacceptable by the Sponsor, in its sole discretion, will be disqualified and will not be published. The Sponsor makes the final determination as to which Submissions are eligible to take part in this Contest. Sponsor reserves the right to modify the criteria, dates, and guidelines of the Contest at any time.

5. SELECTION AND NOTIFICATION OF WINNER

At the close of the Entry Period, a qualified panel of judges ("Judges"), as determined by Sponsor, in its sole discretion, will review each participant's Submission and select the Submissions for fan voting based on the following criteria ("Judging Criteria"): (i) overall performance (1/3); (ii) quality of production (1/3); and (iii) quality of mixing style (1/3). Following the Judges' selection, fans will be able to vote on their favorite Submission (the "Voting Period"). Voting will be done via the Discord Server. Each person may cast up to one (1) vote per verified Discord account per Submission. The use of automated software for voting is strictly prohibited and may result in your disqualification from the Contest. Sponsor, in its sole discretion, reserves the right to exclude any vote(s) that may not comply with the minimum voting requirements set forth herein. At the end of the Voting Period, the Submission with the highest number of votes will be deemed the contest winner (the "Contest Winner"), subject to confirmation of eligibility and compliance with these Terms. If there is a tie for the Contest Winner, then the Contest Winner will be determined by the Judges, who shall assess the tied Submissions based on the Judging Criteria.

On or about Monday, February 17, 2025, the Contest Winner will be notified at the contact information provided on their entry form. Sponsor reserves the right to not select a winner for any or all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. If the Contest Winner fails to comply with any of these Terms or is found to be ineligible or unqualified for any other reason or to have tampered or interfered with the voting process, the Contest Winner may be disqualified and an alternate winner will be chosen based on the next highest number of votes received.

Each participant may be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability, and, if legally permissible, a Publicity Release (collectively, the "Releases") within the time period specified by Sponsor. In addition, the Contest Winner may be required to certify, on information or belief, that their Submission is their original creation and has not been (i) published or (ii) publicized and (iii) has not won another contest. If the Contest Winner fails to complete and return any required Releases within the specified time period, the Contest Winner may be disqualified and an alternate winner will be chosen based on the next highest number of votes received. The Contest Winner may be required to produce government-issued identification.

6. PRIZE

The following prize will be awarded to the winner of the Contest:

- DJ at the Monstercat Stage at the Festival (time slot and date to be determined by Sponsor, in its sole discretion); and

- Social media promotion from Disco Presents, Monstercat, and Ubbi Dubbi (as determined by Sponsor, in its sole discretion).

7. PRIZE CONDITIONS

Attendance at the Festival shall be governed by the Festival's official Ticketing Terms & Conditions (available at https://ubbidubbifestival.com/ticketing-terms-conditions), these Terms, and the issuer's ticketholder agreement. Sponsor is not responsible if Festival is delayed, postponed or cancelled for any reason. Contest Winner will not receive compensation if the Contest Winner is unable to use due to cancellation, postponement or delay of the Festival. Prizes consist of only those items specifically listed as part of the prizes. All travel related expenses for the Contest, including, but not limited to, flights or other transportation to and from the Festival, lodging, food and beverage, taxes, insurance and incidentals are the sole responsibility of the Contest Winner. Sponsor will supply turntables, CDJ players, and standard mixer(s) for use during Contest Winner's Festival performance. Contest Winner is solely responsible for bringing any other equipment he or she may need to the Festival performance. Contest Winner and his or her companion(s) hereby agree that they will at all times comply with applicable laws, including, but not limited to, alcohol (e.g., underage drinking laws) and illegal drug laws. Contest Winner and his or her companion(s) further agree that they will conduct themselves at all times in a socially responsible, respectful and appropriate manner; and, should they fail to do so, the prize may be immediately terminated and the Sponsor may pursue other legal sanctions against the Contest Winner. Contest Winner agrees that he or she will render his or her performance in a professional manner. Contest Winner will not receive compensation from Sponsor if the Contest Winner is unable to perform due to cancellation, postponement or delay of the Festival. In the event a participant is not able to or does not wish to perform, the Sponsor may at its sole discretion choose an alternate winner, or choose not to award the prize at all. No substitution, cash redemption or transfer of prize by Contest Winner is permitted, but Sponsor reserves the right to substitute a prize of equal or greater value. Contest Winner's DJ performance shall at all times be subject to applicable laws and any conditions which Sponsor elects to implement, in Sponsor's sole discretion (including, without limitation, requiring that Contest Winner's DJ performance adhere to the Submission guidelines).

8. RELEASE

By participating in this Contest, participants agree to be bound by the Terms and the decisions of the Sponsor and the Judges. By participating in this Contest, participants hereby waive and release, and agree to hold harmless the Sponsor, the Judges, their respective parent, subsidiary, and affiliate companies, and each of their distributors, licensors, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents (the "Released Parties"), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including, but not limited to, any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize, or their participation in this Contest, or any Contest or prize-related activity. Contest Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize.

9. OWNERSHIP & PUBLICITY

Participant represents and warrants he or she has the full right, title and interest to the Submission and/or a right and license from the owner of the Submission and that he or she will comply with all of these Terms. By entering this Contest and providing a Submission, participant grants Sponsor and its respective parents, affiliates, subsidiaries, agents and licensees, the right to photograph, video and audio record Contest Winner's performance at the Festival and a royalty-free, unconditional, irrevocable, and perpetual right, license and consent, without any compensation, consideration or further notification, to use, edit, reproduce, print, publish, display, transmit, distribute, sell, perform, adapt, enhance, or create derivative works from the DJ performance provided in connection with the Submission and the DJ performance at the Festival, and to use and refer to the participant, his or her name, likeness, image, distinctive characteristics, city, state, any statements made and prize information, for any purpose, including, but not limited to, editorial, advertising, trade, commercial, and publicity purposes in any media throughout the world, unless prohibited by law. Sponsor also has the right to arrange for the news media and journalists to attend and, if applicable record, any public appearances and statements of the Contest Winner. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder.

10. LIMITATION OF LIABILITY

Sponsor and their respective agencies are not responsible for lost, late, damaged, delayed, incomplete, illegible, or misdirected Submissions, Submissions not received by the entry deadline, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions that may limit a user's ability to participate in this Contest, or other hardware, software or technical errors of any kind including any injury or damage to any person's computer related to or resulting from participating in the Contest. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or insufficient space in user's e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest, as determined by Sponsor, in their sole discretion. If the Contest is so cancelled, judging will be conducted from among all eligible Submissions received prior to the time of termination. In the event a dispute arises regarding a specific individual entitled to receive the prize, Submission will be declared made by the "authorized account holder" and any damage made to the website will also be the responsibility of the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide Sponsor with proof that the participant is the authorized account holder of the e-mail address associated with the Submission. Proof of submitting a Submission will not be deemed to be proof of receipt by Sponsor. Detection of any use of robotic, automatic, programmed or similar methods of participation will void all Submissions made by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Terms.

11. DISPUTES

Each participant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in the State of Texas, (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees, and (iii) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of participant and the Sponsor in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Texas or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Texas.

By entering the Contest, participants acknowledge that they are familiar with the provisions of California Civil Code Section 1452, which provides as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM MUST BE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

Accordingly, by entering the Contest, participants (on their behalf and on behalf of their heirs, executors, administrators, personal representatives, predecessors, successors and assigns of any of the foregoing, and all other persons and entities asserting rights of or acting on behalf of the participant) hereby waive and relinquish any right or benefit which participant or such persons has, have or may have against Sponsor and their respective agencies under Section 1542 of the Civil Code of the State of California, or under any similar statutory or common law of any other jurisdiction to the full extent that any such person may lawfully waive such rights and benefits pertaining to the releases set forth in these Terms and Sponsor's Privacy Policy.

12. GENERAL TERMS

INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE DISCORD SERVER OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF THESE OFFICIAL RULES, AND MAY SUBJECT ANY PERSONS INVOLVED TO CRIMINAL AND CIVIL PROSECUTION, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW.

The Contest is subject to all applicable federal, state and local laws and regulations.

13. PRIVACY

By entering the Contest, participants give their express permission to be contacted by Sponsor by e-mail, Discord, or any other contact information provided on the entry form. By participating in this Contest, participants acknowledge and agree that Sponsor may collect and use the personal information submitted by participant to administer this Contest and pursuant to Sponsor's Privacy Policy, located at https://discopresents.com/policy-privacy.
